1. Services
Formulex provides residential and commercial pest control services. The specific services, scope, frequency, and pricing applicable to you will be described at the time of scheduling or in your service agreement. We reserve the right to refuse or discontinue service at our discretion.
2. Scheduling, Access, and Cancellations
- You are responsible for providing safe and reasonable access to the property at the scheduled service time.
- If we cannot access the property or the appointment is not kept, a trip or cancellation fee may apply as described at scheduling.
- We ask that cancellations or rescheduling requests be made in advance. Specific notice requirements will be provided at the time of scheduling or in your service agreement.
3. Pricing and Payment
- Prices for services are as quoted at the time of scheduling or as set out in your service agreement, and may be subject to change with notice.
- Payment is due as described at the time of service or per your agreed billing terms.
- Recurring service plans continue until cancelled in accordance with these Terms or your service agreement.
- Late or unpaid balances may be subject to fees and suspension of service as permitted by law.
4. Service Guarantee
Formulex does not offer free re-services. Any warranty or guarantee applicable to a specific service will be stated in your service agreement or at the time of scheduling. Unless expressly stated in writing, services are provided without a guarantee of results, and additional visits are billed as separate services.
5. Customer Responsibilities
To help ensure effective service, you agree to:
- Provide accurate information about the property and any known pest issues.
- Follow reasonable preparation and post-service instructions we provide.
- Inform us of any conditions relevant to safe service, such as pets, children, allergies, or sensitive individuals on the property.
6. Text Messaging Terms
By providing your phone number and opting in, you consent to receive text messages from Formulex related to scheduling, confirmations, reminders, service updates, account notifications, and, where separately consented, promotional offers.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. Your consent to receive text messages is not a condition of purchasing any service. Our handling of your information is described in our Privacy Policy.
7. Limitation of Liability
To the fullest extent permitted by law, Formulex is not liable for indirect, incidental, special, or consequential damages arising from our services or your use of our website. Pest control results can vary based on property conditions, infestation severity, and factors outside our control, and we do not guarantee complete elimination of pests.
8. Indemnification
You agree to indemnify and hold harmless Formulex and its owners, employees, and agents from claims, damages, or expenses arising from your breach of these Terms or your misuse of our services.
9. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida.
10. Changes to These Terms
We may update these Terms from time to time. The effective date at the top reflects the most recent revision. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
